1.1 All services provided by Cloud Five Limited may be used for lawful purposes only. Transmission, storage, or presentation of any information, data or material in violation of any UK law is prohibited. Services provided by Cloud Five Limited that reside outside of UK must still abide these terms and must not be in violation of any relevant laws of hosting city, state and country. This includes, but is not limited to: copyrighted material, material we judge to be threatening or obscene, or material protected by trade secret and other statute. The subscriber agrees to indemnify and hold harmless Cloud Five Limited and its employees from any claims resulting from the use of the service which damages the subscriber or any other party.
1.2 The provisions of this AUP are intended as guidelines and are not meant to be exhaustive. Generally, conduct that violates law, regulation, or the accepted norms of the Internet community, whether or not expressly mentioned in this AUP, are prohibited. We reserve the right at all times to prohibit activities that damage our or our affiliates' commercial reputation and goodwill. We will be the sole and final arbiter as to what constitutes a violation of our policies.
1.3 All users must comply with all relevant legislation and regulations on bulk and commercial e-mail, including but not limited to the PECR Act of 2003. You may not send unsolicited messages or use the Website or Services to send unsolicited messages (also known as junk mail or SPAM). Forgery of e-mail headers (spoofing) is prohibited.
2.1 Prohibited Uses - Engaging in these activities on our services will result in an account and/or service suspension.
3.1 Fair Usage - Unlimited claims have software and hardware limitations, and are subject to a discretionary fair use policy by our team. If you are using more of any resource than is considered realistic or reasonable for the relevant platform then you will be notified via ticket to reduce your usage. If any user' usage of a resource imposes a risk to the integrity of the platform, they may have their service(s) suspended after notifying via ticket.
3.2 Server resources on our FiberVM Linux platform - CPU, network and disk I/O are shared among other users on the same node. If your VPS is persistently using these resource(s) for a prolonged period of time and/or disrupting the experience of other users sharing the same node, we will notify you to reduce your usage via ticket. Failure to acknowledge an abuse ticket will result in limiting of your vps.
3.3 Server resources on our FiberVM Windows platform - Network and disk I/O are shared among other users on the same node. If your VPS is persistently using these resource(s) for a prolonged period of time and disrupting the experience of other users sharing the same node, we will notify you to reduce your usage via ticket. Failure to acknowledge an abuse ticket will result in limiting of your vps.
3.4 Server resources on our FiberVM KVM platform - Network and disk I/O are shared among other users on the same node. If your VPS is persistently using these resource(s) for a prolonged period of time and disrupting the experience of other users sharing the same node, we will notify you to reduce your usage via ticket. Failure to acknowledge an abuse ticket will result in limiting of your vps.
4.1 Support - All services on our FiberVM platform are unmanaged. In order to successfully manage our VPSs, the client should be familiar with Linux/Windows operating systems, tools, and services. Cloud Five Limited provides basic tools needed to configure and maintain the client’s VPS. Cloud Five Limited also provides remote console access to our VPSs which gives the client a way to access his or her VPS even with a broken SSH configuration.
4.2 Cloud Five Limited works around the clock to ensure that our hardware and network is and up running as expected. The client is responsible for managing his or her FiberVM VPS. Cloud Five Limited staff is available for general support covering the areas including Sales, Network access, Management Panel, Hardware Issue, Scripts and Services offered by Cloud Five Limited. This list may not be exhaustive, but it represents the general idea of our unmanaged hosting. Anything that we do not install and configure for the client is the client’s responsibility and is not covered by our support. We will not install or configure additional packages on a VPS that are not present in our default OS templates unless stated otherwise (i.e Managed service).
5.1 Questioned Uses - The following are acceptable providing they abide with the rest of this policy:
*Any activity that results in attacks against our network may result in a suspension and/or termination.
**Use of these must be used cautiously as they can often be very CPU intensive.
